Terms of Service

1. What Fresim is
Fresim is a platform that lets creators and businesses (“Creators”) launch their own branded storefront to sell eSIM mobile data plans. Fresim handles the underlying eSIM fulfillment (through third-party wholesale providers) and payment processing; each Creator sets their own pricing and brand identity on top of that. When you sign up as a Creator, these Terms govern your use of the platform. When you buy an eSIM through a Creator's storefront, the relevant sections below (Payments, Refunds) apply to you too.
2. Accounts
Creator accounts are created via Google sign-in. You're responsible for the brand name, slug, description, logo, and colors you set for your storefront, and for keeping your account credentials secure. One Fresim account maps to one Creator storefront; a Creator may invite additional team members to help manage the same storefront, and is responsible for their actions on the account.
3. Tiers and what Fresim charges
Every Creator account is on one of four tiers. Fresim's price to you for each eSIM you sell is a flat markup over Fresim's own wholesale cost, and that markup depends on your tier:
- Free — $0/month; your cost is wholesale + 150%.
- Business — $99/month; your cost is wholesale + 100%.
- Dedicated — $399/month; your cost is wholesale + 50%.
- Enterprise — a $10,000, 3-month managed engagement (sales-assisted, not self-serve); your cost is wholesale + 17%.
You price your own customers anywhere at or above your cost and keep 100% of the difference — there is no revenue share. The dashboard shows you your exact cost for every plan before you list it. Business and Dedicated subscriptions are billed monthly through Stripe Billing; you can upgrade, downgrade, or cancel at any time from your dashboard, and cancellation takes effect at the end of the current billing period. Tier pricing and markups may change with notice; changes apply from your next billing period, not retroactively.
4. Creator responsibilities
- Price at or above your cost — your sell price must be at least Fresim's wholesale cost plus your tier's markup (the platform enforces this floor when you list an offer).
- Don't misrepresent what a plan includes (data amount, coverage, duration).
- Comply with applicable law in the markets you sell into, including any telecom or consumer-protection rules that apply to reselling mobile data.
- Don't use Fresim to sell anything other than the eSIM data plans made available through the platform.
5. Payments
Two separate payment relationships exist on Fresim:
- Creators get paid by their customers through Stripe Connect. At the moment of each sale, Stripe splits the payment automatically: Fresim's share (your wholesale cost plus your tier's markup) is collected as a platform fee, and the remainder — your margin — is transferred directly to your connected Stripe account. Fresim never holds your share of the money.
- Creators pay Fresim for Business and Dedicated subscriptions, billed monthly through Stripe Billing. Enterprise engagements are invoiced separately as part of the consulting agreement.
Fresim does not store your payment card details — all card data is handled directly by Stripe.
6. Refunds
If you change your mind, contact us within 7 days of purchase for a full refund — as long as your eSIM has not yet been activated. Once activated, refunds are processed on a case-by-case basis.
Refund requests go to the storefront you bought from, or to Fresim directly at the contact address below — either way we'll route it to the right place. Where a refund is granted, it is returned to the original payment method via Stripe.
7. Third-party services
Fresim relies on third-party providers to operate: Stripe (payments and payouts), eSIM Access and Airalo (wholesale eSIM provisioning and delivery), Google (sign-in and transactional email), Supabase (database hosting), and Expo (mobile push notifications). eSIM connectivity is provided by the mobile networks those wholesale providers partner with — not by Fresim itself. Your use of Fresim is also subject to those providers' own terms where applicable, and outages or changes on their end can affect Fresim's service.
8. Prohibited uses
- Attempting to circumvent rate limits, price floors, or payment flows.
- Scraping, reverse-engineering, or reselling access to the platform itself.
- Uploading brand content (name, description, logo) that is unlawful, infringing, or misleading.
- Using the platform to facilitate fraud, money laundering, or any illegal activity.
9. Termination
You may stop using Fresim at any time. Fresim may suspend or terminate a Creator account for violating these Terms, including fraudulent claims, payment fraud, or abuse of the platform. On termination, completed sales remain subject to the payment and refund terms above.
10. Disclaimers
Fresim is provided “as is.” eSIM connectivity, coverage, and data speeds depend on third-party carriers and providers and are not guaranteed by Fresim. To the extent permitted by law, Fresim is not liable for indirect, incidental, or consequential damages arising from use of the platform.
11. Governing law and legal entity
Fresim is operated by Alex Hile, trading as Fresim, a sole trader established in Australia (“Fresim”, “we”, “us”). Fresim is the contracting party under these Terms.
These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of Australia. You and Fresim submit to the non-exclusive jurisdiction of the Australian courts. Nothing in these Terms limits any non-excludable rights you may have under the consumer law of your own country of residence.
